The Nest Membership Terms and Conditions

1. Introduction

1.1 These terms and conditions apply to the membership services provided by The Nest and Health Group Limited ("The Nest"), a company registered in England and Wales under company number 13888976, with its registered address at The Granary And Stables, Watermill House, Chevening Road, Chipstead, Sevenoaks, Kent, England, TN13 2RY.

1.2 By purchasing a membership, you agree to comply with and be bound by these terms and conditions.

2. Membership Types and Benefits

2.1 The Nest offers an annual membership ("Membership") with the option to pay either monthly or annually in advance.

2.2 Membership provides access to included classes and services each month, as well as discounted rates on additional services.

2.3 The specific benefits of Membership are detailed on The Nest’s website and may be updated from time to time.

3. Membership Fees and Payment

3.1 Membership fees are payable either monthly or annually in advance, as per the chosen payment option.

3.2 Payment must be made via the payment methods specified by The Nest.

3.3 The Nest reserves the right to adjust Membership fees, with 30 days' notice provided to members of any changes.

3.4 Late payments may incur additional fees, and The Nest reserves the right to suspend Membership until payments are up to date.

4. Membership Term and Cancellation

4.1 Membership is offered on an annual basis and will automatically renew each year unless cancelled by the member in writing at least 30 days before the renewal date.

4.2 Members may cancel their Membership at any time by providing written notice to The Nest; however, the Membership will remain active until the end of the annual period.

4.3 The Nest may terminate a Membership without notice if the member fails to comply with these terms and conditions, engages in conduct deemed harmful to The Nest or its members, or fails to adhere to the club rules.

5. Refunds

5.1 Membership fees are non-refundable except where The Nest is unable to provide the services offered for a continuous period exceeding 10 days, in which case a pro-rata refund may be issued for the period affected.

5.2 Refund requests must be submitted in writing and will be processed according to the conditions set forth herein.

6. Use of Facilities, Booking Services, and Rules

6.1 Members must book classes and services in advance where required. Bookings are subject to availability.

6.2 Members must adhere to The Nest’s policies, including any health and safety guidelines, while using the facilities.

6.3 The Nest reserves the right to refuse access or terminate memberships for breaches of these terms, including failure to comply with safety instructions and proper equipment use.

7. Changes to Services

7.1 The Nest reserves the right to modify, suspend, or discontinue any included classes, services, or benefits.

7.2 Changes will be communicated through official channels, such as email or The Nest’s website.

8. Liability and Personal Injury

8.1 Members use The Nest’s facilities at their own risk. The Nest does not accept liability for any personal injury, loss, or damage to property unless caused by the negligence of The Nest or its employees.

8.2 The Nest and its employees will not be liable for any loss or injury that occurs if a member fails to adhere to health disclaimers or instructions provided by The Nest.

8.3 Members are advised to seek medical advice before engaging in any classes or services provided by The Nest.

9. Data Protection and Privacy

9.1 The Nest will handle members’ personal data in accordance with its Privacy Policy and applicable data protection laws.

9.2 Personal information may be used for marketing purposes; members have the right to opt out of receiving marketing communications.

10. Governing Law and Jurisdiction

10.1 These terms and conditions, and any disputes arising from or related to them, are governed by and construed in accordance with the laws of England and Wales.

10.2 The courts of England and Wales will have exclusive jurisdiction to settle any disputes arising under or in connection with these terms and conditions.

11. Amendments

11.1 The Nest reserves the right to amend these terms and conditions from time to time. Members will be notified of any significant changes.

11.2 Changes to the terms will take effect 30 days after notification is provided.

12. Complaints and Disputes

12.1 Any complaints regarding the services provided should be submitted in writing to The Nest’s management.

12.2 Disputes will be handled in accordance with the laws of England and Wales, and The Nest will work to resolve issues in a fair and timely manner.
